§ 5.08.010. DEFINITIONS.

  • In this chapter, the following words and phrases shall have the meanings defined below unless the context requires otherwise:
    A. CHARACTER. A person's attributes, traits, moral qualities, or abilities.
    B. PEDDLER. Any person, whether a resident of Lake Havasu City or not, who goes from house to house, office to office, business to business, place to place, street to street, or in public places, conveying or transporting goods, wares or merchandise or offering or exposing the same for sale, or making sales and delivering articles to purchasers.
    C. PORTABLE SIGN. Any sign not permanently affixed to the ground or the structure on the site it occupies.
    D. SIGN. Any device for visual communication which is used or intended to attract the attention of the public for business or professional purposes, when the display of this device is visible beyond the boundaries of the property upon which the display is located. The term SIGN shall not include any flag, badge or insignia of any government or governmental agency. The term SIGN shall not include the displays or advertising devices in a merchant's window or within the interior of a building.
    E. SOLICITOR. Any person, whether a resident of the city or not, who goes from house to house, office to office, business to business, place to place, street to street, or in public places, soliciting, taking or attempting to take orders for sale of goods, wares or merchandise, including magazines, books, periodicals or personal property of any nature whatsoever for future delivery, or for service to be performed in the future, whether or not the individual has, carries or exposes for sale a sample of the subject of the order, or whether or not he or she is collecting advance payments on the orders. The definition includes any person who, for himself or for another person, hires, leases, uses or occupies any building, motor vehicle, trailer, structure, tent, railroad box car, boat, hotel or motel room, lodging house, apartment, shop or other place within the city for the primary purpose of exhibiting samples and taking orders for future delivery.
    F. STRUCTURE. Any object constructed or installed by a person, having a permanent location on the ground.
    G. TEMPORARY SIGN. Any sign not intended for permanent display.
    H. TRANSIENT MERCHANT. Includes any persons, whether as owner, agent, consignee or employee, whether a resident of the city or not, who engages in the business of the sale and delivery of goods, wares and merchandise within the city; and who, in furtherance of the business hires, leases, uses or occupies any approved building, structure, tent, public room in hotels or motels, lodging houses, apartments, shops or other approved structures within the city for the exhibition and sale of the goods, wares and merchandise.
